A Homeowners' Association (HOA) is a legal entity created by a real estate developer for the purpose of developing, managing and selling a community of homes. It is given the authority to enforce the covenants, conditions & restrictions (CC&Rs) and to manage the common amenities of the development. It allows a developer to end their responsibility over the community, typically by transferring ownership of the association to the homeowners after selling. Generally accepted as a voluntary association of homeowners gathered together to protect their property values and to improve the neighborhood, a large percentage of U.S neighborhoods where free standing homes exist have an HOA. Most homeowners' associations are nonprofit organizations and are subject to state statutes that govern non-profit corporations and homeowners' associations.

Why do we pay dues?
You pay HOA dues to contribute to the maintenance and upkeep of shared common areas within your community, like landscaping, swimming pools, parking lots, and other amenities, which are managed by the Homeowners Association (HOA); essentially, you pay to ensure the overall quality and value of your neighborhood remains high by covering costs like landscaping, repairs, security, and utilities for common spaces.
What is included in the dues?
HOA dues typically include the costs of maintaining common areas like landscaping, pool upkeep, snow removal, trash removal, security services, common area utilities, and reserve funds for future major repairs
How do I pay my dues?
Instructions on paying your dues are included in the assessment letter you receive in the mail each quarter.
However, here are several ways you can pay your dues. these include:

Mail your payment to the P.O. box listed in you assessment letter.

What is a Reserve account?
A reserve account is a non-transactional account that holds funds for a specific purpose in the future. A Reserve Study is used estimate future expenditures so that appropriate reserve accounts can be funded.

A reserve study is a long-term financial planning tool that analyzes the physical condition of a property's common areas and its current reserve fund, then recommends a stable funding plan to ensure sufficient money is available for future repairs and replacements of major components like roofs, pavement, or building systems, when they reach the end of their useful life.

What are CC&R's?
The term CC&R refers to 'Covenants, Conditions & Restrictions.' A real covenant is a legal obligation imposed in a deed by the seller of a home and or property upon the buyer of the real estate to do or not to do something. Such restrictions frequently 'run with the land' and are enforceable on future buyers of the property. Examples might be to maintain a property in a reasonable state of repair, to preserve a sight-line for a neighboring property, not to run a business from a residence, or not to build on certain parts of the property. Many covenants are very simple and are meant only to protect a neighborhood from homeowners destroying trees or historic things or otherwise directly harming property values. Some can be more specific and strict, outlining everything a homeowner can do to the exterior of their home, including the number of non-familial tenants one may have, acceptable colors to re-paint the home, exactly when holiday decorations are allowed up, automobile placement or repair on property, satellite placement, etc

What are 'ByLaws'?
A set of rules or guidelines regarding the operation of a non-profit corporation such as a Board. Bylaws generally set forth definitions of offices and committees involved with the Board of Directors. They can include voting rights, meetings, notices, and other areas involved with the successful operation of the Association.

What is a 'Handbook'?
An HOA handbook, often referred to as a "community guide" or simply "rules and regulations," is a document that outlines the guidelines and expectations for homeowners living within a Homeowners Association (HOA), detailing the rules they must follow regarding property maintenance, community use, and other aspects of living in the neighborhood, typically including information from both the HOA's Bylaws and Covenants, Conditions, and Restrictions (CC&Rs).

Who Maintains the Roads?
The roads are maintained by NC DOT with the exception of the pool entrance and parking lot south of Sandtyn an Baylor.
Who Maintains the Lights?
The street lights are maintained by Union Power. To report an outage, use the Street Light Repair form. You will need the number from the yellow tag attached to the light.
What are the pool hours?

Can we rent the pool for parties?
No. The pool open to all lot owners in good standing at all times when the pool is scheduled to be open. However, you can have parties at the pool. We ask that you are considerate of any others using the pool at the same time (e.g keep music level reasonable, etc.)

Can we use the pool parking lot for overflow parking?
Absolutely! if you need to park for more than one day we ask that you get written approval from the Board in advance of the dates you will need to park at the pool so that there is no risk of your vehicle being towed. Simply email the Board with your request and include the following:

Your street address
Vehicle information
Make
Model
Color
License plate number
Dates the vehicle will be parked in the pool parking lot
What are policies regarding outdoor grills and fire-pits?
Temporary ones are allowed, but need to be stored away or at least covered/out of sight when not in use. Anything permanent needs ACC approval.
Are “For Lease” or “For Sale” signs, banners, or other billboards welcome?
One "reasonably sized" "for lease" or "for sale" is allowed pursuant article 7 section 4 of the CCR's. For all other signage restrictions, refer to the current Handbook.
What kind of mailbox can I have?
Mailboxes of the type and style originally placed by the builder must be used to replace damaged boxes. No ornamental or other styles of mailboxes and or posts are permitted. See the current Handbook for additional mailbox information.

Is my mailbox required to have a specific font for letters and numbers?
Yes. Mailbox number should match the size color and font that came on the original mailbox, contact contact Watson Steel & Iron Works for more information.
Can I install rooftop solar panels?
Installation of solar panels currently requires ACC Committee approval. Solar panels must be install on the roof whereas they not visible to the street. As this is a new technology (from a legal perspective) available after our CCR's were written, and the the fact that the NC Solar Access law (sb670) does not apply to our community, we are in a "wait and see" position regarding the legal direction in which we will take. if any legislation changes made are applicable to our community, this faq will be updated to reflect the change.
Are campers/commercial vehicles allowed?
No. campers, commercial vehicles, and trailer are not allowed unless they can be stored in your garage with the ability to close the garage door.
